The use of the Website, browsing its contents and\/or accessing the Services grants the status of customer of the Website (hereinafter, the \u201ccustomer\u201d) and implies full and unreserved acceptance of each and every provision included in these Terms of Use in the version published by YOKOLOGICAL S.L. at the very moment the customer accesses the Website. In accordance with consumer protection regulations, we inform you that this contract shall be formalised in Spanish.<\/p>\n\n\n\n

If the purchase through our website www.foxinaboxmadrid.com is made by a legal entity, the person completing the registration form declares that they are acting on behalf of the legal entity they represent. In any case, when completing the contact forms on the Website, all information provided must be truthful, accurate and complete. For these purposes, the customer guarantees the authenticity of all data communicated. 3. PURCHASE TERMS AND CONDITIONS<\/h3>\n\n\n\n

Access to the games offered on the website whose URL is www.foxinaboxmadrid.com may only be purchased by following the procedure established by YOKOLOGICAL S.L. Until your request has been accepted by YOKOLOGICAL S.L., you will not have the right to enjoy the service.<\/p>\n\n\n\n

3.1. PURCHASE PROCEDURE<\/h3>\n\n\n\n

The purchase of admission to the games offered by YOKOLOGICAL S.L. shall be carried out through the Website by means of electronic contracting. The customer must access the Website to request the acquisition of the right to enjoy the games offered by YOKOLOGICAL S.L., where the details of the purchase will be specified: selected game, day and time of access to the game, number of players, service address and cancellation insurance.<\/p>\n\n\n\n

Once the form appearing on the website has been completed, the customer will confirm acceptance of the terms and the price, which will be defined on the website and during the purchase process, including all expenses and taxes to be paid in order to comply with applicable legislation.<\/p>\n\n\n\n

3.2. GAMES AVAILABLE ON THIS WEBSITE<\/h3>\n\n\n\n

On the website, 9 games can be purchased directly at our facilities and 1 game can be purchased for the location chosen by the customer. Prices vary depending on the type of game and the number of players, as shown in the description appearing on the sales page.<\/p>\n\n\n\n

The purchase form will request the following information: full name, email address, telephone number and postal address. During the website payment process: card details for the POS terminal, Tax ID\/VAT number and postal address. Once the form has been completed and the terms and conditions of purchase have been accepted, payment will be processed.<\/p>\n\n\n\n

You will be informed of the Terms and Conditions of purchase that you must accept; please read them before confirming acceptance. The customer will have the option to download or print them, regardless of the fact that they will also be sent by email to the email address provided, together with the details of the order. The invoice will be available upon request by email or form.<\/p>\n\n\n\n

Once the terms and conditions have been accepted and payment has been made, the purchase shall be considered formalised and YOKOLOGIKAL SL will provide the service under the specified conditions.<\/p>\n\n\n\n

Orders placed by residents in countries of the European Union shall be subject to Regulation (EU) 2018\/302 of the European Parliament and of the Council of 28 February 2018 on addressing unjustified geo-blocking and other forms of discrimination based on customers’ nationality, place of residence or place of establishment within the internal market (hereinafter, the Geo-blocking Regulation).<\/p>\n\n\n\n

3.3. RETURNS POLICY<\/h3>\n\n\n\n

If the customer unilaterally cancels their reserved session, YOKOLOGICAL SL undertakes to issue a discount voucher for the same amount paid, under the following conditions:<\/p>\n\n\n\n

\u00abIf the Change Insurance has not been purchased, the customer must provide notice at least 72 hours before the game.\u00bb If the Change Insurance has been purchased, the customer must provide notice at least 15 minutes before the game. The customer will receive the discount code with instructions at the email address provided in the booking, valid for the following 3 months. The discount code will be issued within 1\u20135 working days. Under no circumstances will there be any refund of the amount paid.<\/p>\n\n\n\n

If the activity must be cancelled due to non-compliance with the company’s general rules and\/or admission rules, the user shall not receive any compensation or refund.<\/p>\n\n\n\n

3.4. SHIPPING AND DELIVERY<\/h3>\n\n\n\n

Once the payment process has been completed, YOKOLOGICAL S.L. will make available to you the right to enjoy the service on the date and under the conditions specified in the contract between both parties.<\/p>\n\n\n\n

In the case of purchasing a gift card with postal delivery, it will be sent within 48 hours, excluding weekends and public holidays. Deliveries are limited to mainland Spain.<\/p>\n\n\n\n

3.5. PRICES AND PAYMENT METHOD<\/h3>\n\n\n\n

The prices of our games are shown in euros.<\/p>\n\n\n\n

In accordance with applicable legislation, every purchase made from our website will be subject to Value Added Tax (VAT) or any other indirect tax and\/or duty. According to Spanish regulations, we are required to issue an invoice for orders above \u20ac3,000 (taxes included).<\/p>\n\n\n\n

Prices are calculated according to the number of participants and based on the selected game.<\/p>\n\n\n\n

Payment will be made through POS terminal or PayPal.<\/p>\n\n\n\n

YOKOLOGICAL S.L., or third parties whose rights are legitimately held by YOKOLOGICAL S.L., owns and\/or is the licensee of all information contained on the Website, its graphic design, images, software, databases, indexes, source codes, trademarks, industrial designs, logos, service names and any other signs capable of industrial and\/or commercial use, all of which are protected in accordance with the provisions of Intellectual Property Law, Trademark Law and any other applicable legislation (hereinafter, the Website Contents). Making them available and using them does not, under any circumstances, imply the transfer of any exploitation rights over them or the granting of a right of use in your favour or in favour of third parties who may illegitimately access the Website contents; therefore, any reproduction, copying, distribution, total or partial commercialisation, public communication and transformation will require the prior written authorisation of YOKOLOGICAL S.L.<\/p>\n\n\n\n

YOKOLOGICAL S.L. only assumes responsibility for contents owned by it, which will be identified with the \u00a9copyright symbol. The duration of the acquisition of the right to enjoy our games will be for the duration of the selected activity. However, YOKOLOGICAL S.L. reserves the right to cancel the activity if such enjoyment has involved any illegal, unlawful or morally improper activity by the customer.<\/p>\n\n\n\n

YOKOLOGIKAL S.L. is nevertheless authorised to terminate or suspend the provision of the Website at any time. In any case, YOKOLOGICAL S.L. will fulfil confirmed Orders.<\/p>\n\n\n\n

Whenever reasonably possible, YOKOLOGICAL S.L. will give as much prior notice as possible of the termination or suspension of the Website service.<\/p>\n\n\n\n

8. ASSIGNMENT<\/h3>\n\n\n\n

The customer may not assign this contract (in whole or in part) without the prior written consent of YOKOLOGICAL S.L. However, YOKOLOGICAL S.L. may assign all or part of this Contract to any entity that may in the future take charge of providing the Services included on the Website, giving thirty days’ prior notice.<\/p>\n\n\n\n

9. APPLICABLE LAW AND JURISDICTION<\/h3>\n\n\n\n

These Terms are governed by and interpreted in accordance with the Spanish legislation in force. For any dispute that may arise, the customer agrees to submit to the jurisdiction of the Courts of Madrid, unless the application of the law results in another competent jurisdiction. Notwithstanding the foregoing, the parties shall do everything reasonably necessary to resolve disputes amicably.<\/p>\n\n\n\n
